The court may ask the other spouse to transfer a certain percentage of their wages to the custodial parent. This way, the custodial parent can be sure to receive the child support every time the other parent receives their paycheck.
Family law attorney Ethan Steward adds that if the former spouse is not employed, the custodial parent may file a writ of execution. The writ of execution will allow the court to seize the ex-spouse’s assets like bank accounts or stock holdings. Usually, this situation will be allowed by the court if the other parent owes a substantial amount of child support.
In the article, the lawyers add that “The law requires all parents to offer financial assistance to their children. If your former spouse fails or refuses to pay for child support, you have the right to file contempt proceedings, writ of execution, and motion proceedings.
